ORDINANCE NO. 2026-271

AN ORDINANCE AMENDING CHAPTER 10 (“UTILITIES”) OF THE CODE OF ORDINANCES OF THE TOWN OF LIVONIA, LOUISIANA, TO ADD MISCELLANEOUS CHARGES FOR WATER AND GAS CUSTOMERS, AND PROVIDING FOR RELATED MATTERS.

WHEREAS, the Town of Livonia (“Town”) provides water and gas utility services to customers within its jurisdiction pursuant to Chapter 10 of its Code of Ordinances - Town of Livonia.

WHEREAS, costs associated with the purchase, installation, operation, and maintenance of advanced metering infrastructure, remote‐reading systems, controls, data management platforms, and other utility technology have increased, and the Town finds it appropriate to adopt a separate technology fee to recover these costs in a fair and transparent manner and provide for other miscellaneous fees.

NOW, THEREFORE, BE IT ORDAINED by the Town Council of the Town of Livonia, Louisiana, in regular session assembled, that:

Article A. General   Chapter 10 (“Utilities”) of the Code of Ordinances of the Town of Livonia is hereby amended by adding the following new Appendix B to Article A. General

 Appendix B.  Miscellaneous charges for utility-related services.

1. Tampering Fees

Water or gas meter tampering charges (with levels of each tampering violation to be the subjective determination of the Livonia Utility System):

• Level 1 – Water or gas tampering (remove locking device, etc.) - $50.00
• Level 2 – Water or gas tampering (damage to valves, meter boxes, or town piping, etc.) - $150.00
• Level 3 – Water or gas tampering (using jumper device or a stolen meter/regular, damage to meter transmitters, etc.) - $200.00
• Level 4 – Required participation of the Livonia Police Department and/or Livonia Town Court. Damages shall include all additional costs of labor and materials to replace damaged equipment, including all other court costs, attorney fees, etc.

2. The fee may be adjusted from time to time by resolution of the Town Council, provided that any adjustment shall be reflected in the next bill cycle after adoption of the resolution.
3. Severability. If any section or subsection of this ordinance is declared invalid or unconstitutional, such declaration shall not affect the validity of the remaining portions of the ordinance.
4. Repealer. All ordinances or parts thereof in conflict with this ordinance are hereby repealed to the extent of such conflict.

Said Ordinance having been introduced on May 11, 2026, by LeJeune,  notice of public hearing having been published, said public hearing having been held, the title having been read and the Ordinance considered, a motion was made by Bergeron and seconded by   T. Jarreau to adopt the Ordinance.  A record vote was taken and the following results were had:

Whereupon, the Ordinance was declared adopted on this 9th day of June 2026.
